Fine proceedings Operational controls

As part of operational controls, the operational control services also carry out administrative fines.

Federal Highway Toll Act (BFStrMG):
If violations of the Federal Highway Toll Act (BFStrMG) are found during an operational toll inspection, these offences will also be punished within the scope of the operational inspection. The sanction can affect everyone involved in the transport process (e.g. entrepreneur, driver or dispatcher). The amount of the fine is based on the catalogue of fines issued by the Federal Ministry of Transport and Digital Infrastructure. Fines of up to 20,000.00 Euro per act can be imposed.

Road Freight Transport Act (GüKG):
Findings from the operational controls of road freight transport are processed by the operational control service in administrative offence proceedings. The Federal Office issues fines or confiscation notices against clients and non-resident (foreign) carriers, especially against the latter for violations of cabotage regulations.
Any violations found by resident (domestic) carriers are passed on to the responsible traffic authorities of the Federal States for further prosecution.
